Trump’s tariffs encounter legal challenge from small businesses

Small businesses in the United States have initiated legal action against the recent round of tariffs imposed by the Trump administration, which affect approximately 60 trading partners and cover nearly all U.S. imports. The lawsuits, filed in the Court of International Trade, challenge the legality and rationale behind these tariffs.

Legal Actions Against New Tariffs

Two separate lawsuits have been launched by businesses, including Learning Resources, an educational toy company that previously achieved victory in a Supreme Court case regarding tariffs. The lawsuits allege that the government failed to adequately justify its case against individual economies and did not sufficiently demonstrate how the tariffs would eliminate practices associated with forced labor, as mandated by Section 301 of the Trade Act of 1974.

The second lawsuit is being brought forward by Burlap and Barrel, a spice company based in New York, and Collective Horology, a watch retailer from Ventura, California. These businesses are represented by the Liberty Justice Center, a libertarian advocacy organization. Sara Albrecht, the center’s chairman and CEO, emphasized that even though forced labor is a significant issue, it does not authorize the government to violate legal procedures.

Albrecht remarked, “The administration allowed one global tariff to expire and immediately replaced it with another under a different statute. Changing the statute doesn’t change the law.” This sentiment highlights the contention that the new tariffs are essentially a continuation of previous ones, which faced judicial scrutiny.

Experts suggest that the upcoming legal challenges may be more difficult to win compared to earlier rounds of tariffs imposed by the Trump administration. During his first term, Section 301 tariffs on China were upheld in court. Legal expert Patrick Childress noted that unlike the recently expired tariffs, the new tariffs are expected to be more durable, presenting ongoing implications for businesses.

Childress stated, “These tariffs will be with us for the long haul,” indicating that the removal of tariffs will likely require countries to meet stringent enforcement criteria, further complicating potential legal challenges.

The White House did not provide immediate comments regarding the lawsuits.

Why It Matters: The outcome of these legal challenges could have significant ramifications for U.S. trade policy and its relationship with other countries, as well as for domestic businesses that may be affected by the increased costs associated with tariffs.
