Federal and state regulations seek to address the rising threat of deepfakes

In response to the growing concern over deepfakes—manipulated images and videos that misrepresent individuals—both federal and state governments in the United States are moving to establish regulations aimed at mitigating the associated risks. Deepfakes can lead to various issues, including defamation, fraud, and threats to public safety, prompting a significant push for legislative action.

Deepfakes gained widespread attention in early 2023, highlighted by a viral image of Pope Francis in a puffer coat that misled many viewers. Similarly, explicit deepfake images of singer Taylor Swift circulated in January 2024, eliciting significant backlash from her fanbase. Such incidents have underscored the potential for deepfakes to cause harm and incite unrest.

Federal Legislation to Combat Deepfakes

Currently, no comprehensive federal law specifically regulates deepfakes in the United States. However, the Identifying Outputs of Generative Adversarial Networks Act mandates research into standards for generative adversarial networks (GANs), which are essential for producing and detecting deepfakes. Additionally, Congress is considering several bills aimed at addressing this issue.

The proposed legislation includes the Deepfake Report Act of 2019, which tasks the Department of Homeland Security with providing regular updates on digital content forgery technology. Another measure, the DEEPFAKES Accountability Act, seeks to enhance national security and provide legal recourse for victims harmed by deepfakes. Other bills, such as the DEFIANCE Act of 2024 and the Protecting Consumers from Deceptive AI Act, also aim to address the implications of artificial intelligence in media.

Concurrent with federal efforts, numerous states have enacted their own regulations concerning deepfakes. For instance, Texas has made it a criminal offense to create misleading videos aimed at undermining political candidates. Florida and Louisiana have implemented laws against deepfakes that involve minors, while Indiana and New Mexico have introduced legal disclaimers for media containing fabricated content.

Other states, including Washington and Tennessee, are also pursuing legislation that grants victims legal remedies for the unauthorized use of their images and likenesses. Bills addressing deepfake regulations are still under consideration in states like California and Ohio.

Why It Matters

The increasing prevalence of deepfakes poses real challenges for information integrity, personal privacy, and public safety. As both federal and state governments take action to regulate this technology, it is essential for individuals and businesses to stay informed and adapt to the evolving digital landscape. By establishing clear regulations and promoting digital literacy, authorities aim to protect citizens from the detrimental effects of deepfake technology.
